CMS has developed a multi-phased approach to dispute analysis that allows a client the opportunity to focus the scope while balancing the scope and cost of each individual activity with dispute magnitude. Phase I is a lump sum priced evaluation comprised of CMS senior personnel who perform review of selected project documentation, identification of potential issues in dispute and a preliminary evaluation of risks for decision making by the client and counsel. This review allows the client to make a go/no-go decision relative to whether to continue with the dispute or settlement. Phase II follows the Phase I decision to go forward with the dispute. The Phase II plan is a focused, task oriented analysis effort that flows from the Phase I effort. CMS presents a team approach with a broad experience base and specialized expertise. The final work product provides a completely supported and quality expert analysis for use by the client and its counsel. When the dispute approaches negotiation or formal dispute resolution effort, Phase III services may be required. These services include assisting client and counsel in preparing presentations, cross-examination of fact and expert witnesses, and presentation of expert testimony if required.
